Here is the difficulty –

I have a roommate who tells me she would like to move out in April 1st (and reside with her mother and father) at 12th of March i.e. I was told she would vacate in 18 days.

I just want to know whether I really should give her complete safety back? Am I entitled to do it even if I do not have complete month to search for yet another roommate? She is adamant to move out in April and wants her safety back. I am unable to get anybody to reside with me till date.

I believe that this is not counted as 1 month’s notice. I am new to New York, so I was asking yourself if there is any this kind of factor either as “one particular month’s notice”.

You would only be needed to give her back half of her deposit because it is in fact “30 days notice” That is needed, they do not say “1 month” because not all months equal 30 days. Considering that she is vacating at generally half of the 30 days she is not entitled to the full deposit back.
