Question by jffschorr: Can a employer take you off the schedule fully following you turn in your two week recognize?”?
I place in my notice on sunday then i had two trip then on weds. i was late by 25 min and she stated that she had replaced me for the rest of the week but she did not fire me. Can she do that?

she must not put an employee in a position of making less than he should have… look at the labor standards act
you can not have your hours cut for giving notice
by doing that is is called creating a hardship… it is not allowed

LikeDislikeIf you’re part time, absolutely. They are not required to schedule you or give you hours. If you’re leaving anyway, most employers use the “They probably won’t be very productive, anyway” approach. If you’re full time or salary, then technically no, because being so guarantees you money/hours/work/job security.

LikeDislikeYes they can let you go after you give your two weeks notice. Most companies do this because you may not be productive at work or you may steal from the company. What is funny is if you just up and quit, the company can burn you and not give you a job reference.

I would say given the fact you turned in a two-week notice, you are an “at will” employee. If you are an at will employee, have a few days off until you start your new job.
The reason your boss replaced you early is because studies have shown that employee moral and production goes down greatly once a two-week notice is given. Who wants a guy hanging out at work who cant show up on-time and most likely is not that interested in performing daily duties that the job requires. After all, if you still had your heart in the job, you would have been on-time the other day.

LikeDislikeThat is usually what happens, actually. The “2 week notice” is a tool that is designed to benefit the employer. And if it is reasoned to be against his interests to use you as he previously did, it is his prerogative. Some even believe that you may “poison” the work environment after you’ve decided to leave this employ.
