My apartment contract was set to finish June 30th, 2009. The spot was terrible, so we moved out Could 15th, and made the decision to spend twice as considerably rent just so we could get out of there. Starting Could 1st or so, we visited the front office 5-10 instances, and asked specific questions about moving out, like “Do we require to fill out any types?” They said that we can spend June’s rent as soon as feasible, and to turn in the keys as soon as the spot is clean. *They go by way of a lot of folks in the front office.* We received a bill in the mail for July’s rent, and when I referred to as the manager, she mentioned that we had to give 30 day discover in writing. I told her that we asked what to do over and over and that no 1 helped us. They do not care. I known as the organization who owns the apartments and talked to someone and they stated the identical thing. Is there anybody else I can speak to? Am I entirely screwed here?

your not living there so you dont have to pay julys rent and you currently paid your lease up to date beofre you moved. I believe there getting a bunch of jerks and you really should just call a lawyer DONT Pay THEM Any longer Even though

Most likely they prob didn’t tell you because they figured that you already knew since it’s pretty much mandatory everywhere to give a 30 day notice. But yes, you are responsible for giving out a 30 day notice anytime you go to move out of any apartment and you are responsible in paying July’s rent. If you ever go to move out of your new apartment, even if they don’t tell you, make sure to give them the written notice. And if you ever go and give out a 30 day notice and decide to stay after giving out a 30 day notice, you will also need to go ahead and give them a written notice stating that you will be staying in the apartment. Or if you give a 30 day notice and notice that you need additional time to move, then after that written 30 day notice, you will need to write up another 30 day notice. Hope this helps.
Also, If you don’t pay it, either 2 things could happen. 1. They could take you to court. or 2. They can put it onto your credit report and a nonpayment and make your credit report look bad.

LikeDislikeEverything needs to be in writing. You are always required to give a written notice along with a forwarding address when you rent an apartment anywhere. They cannot bill you for any time that is not stated in the contract, unless it says somewhere in the contract that a written notice is required or else they will automatically renew the contract. Apartments can be shady, so please go back and read the lease agreement!

I moved out of state so I couldn’t do anything about it, but the apt manager kept most of my $ 1,100 deposit. I didn’t give 30 days notice because I had to move for a job, so I did have to pay one month’s rent. But I also got reamed on the cleaning because the cleaning crew I hired came in after I already left the state. The apt mgr said they didn’t do a good job and kept a large chunk of my deposit. What could I do? I was starting a new job in another state. It would’ve cost me just as much to go back and fight them about it. So I gave it up. I know it’s awful, but it seems like a lot of us get ripped when we move out of an apt. I’m always hearing bad stories.

LikeDislikeIf your contract ended on June 30th and you paid rent thru June 30th then they have no claim against you. Your contract is finished, unless there is a clause for automatic renewal. There may be a paragraph that states the lease will revert to a month-to-month lease. There may also be a paragraph where you agree to give 30 days notice.
In that case you should document everything as well as possible, particularly the date you returned the keys. If an employee of the rental agency accepted your keys before the end of May, and you paid thru end of June, any claim for damages against you would be fairly weak. Handing over the keys, and an employee of the landlord accepting, is a pretty strong action indicating you are/ or have vacated the apartment, and the landlord’s accepting your action.
In future you should always read your lease contract, and understand it. If you can’t understand all the legal terms then bring a friend with you or get a copy in advance to review with someone knowledgeable. Take notes so you remember what your responsibilities are. Always give written notice of your actions under any contract, including vacating leased premises.
One thing that may defuse the landlord’s actions against you is if the unit is already rented, particularly if it was rented in May or on/ around the beginning of June, or if the landlord advertised the unit for rent in May. This would be fairly concrete evidence that the landlord was aware of what you did. Really, the acts of accepting the keys from you, and accepting June’s rent, should suffice as proof the landlord was fully aware of your actions, written notice or not.
Another thing, where did you receive the bill for the July rent? Was it at a new address, or was it forwarded from your old address. Go talk to the neighbors, ask them if the apartment has been shown to any prospective tenants or had maintenance. For your contract to be still in force, the landlord must be completely unaware you moved, this would include never entering the apartment… I think there’s a lot working against the landlord’s assertion that you did not give notice. You just didn’t give it in writing. Technically incorrect, but unless the landlord can prove some sort of damages, probably not a problem.

LikeDislikewow, renezz— that was completely unhelpful. sorry, kelly, that this happened to you, but unfortunately, this is a common issue with apartment renters. it’s shocking that you specifically asked if you needed to fill out any forms, and they didn’t provide you with a move-out form. poor communication on their part is partially to blame, but you have learned the hard way about that little 30 day notice detail. ALWAYS GIVE IT TO THEM IN WRITING…
